Stamp duty is calculated based on the total rent amount and the duration of the tenancy:

Current 2026 rate note: Under the Finance Act 2024 (effective 1 January 2025), the old RM2,400 annual rental exemption has been removed. Stamp duty is charged from the first ringgit of annual rent.

  • 1 year or less: RM1 for every RM250 of total annual rent
  • 1 to 3 years: RM3 for every RM250 of total annual rent
  • 3 to 5 years: RM5 for every RM250 of total annual rent
  • More than 5 years: RM7 for every RM250 of total annual rent
  • Minimum stamp duty: RM10 on all dutiable tenancy agreements

Here’s an example for a one-year tenancy agreement with a monthly rental of RM1,000:

  • Stamp duty (2026 rates): (RM12,000 ÷ RM250) x RM1 = RM48
  • Stamp duty: RM48 before additional-copy fees. Legal or platform charges should be checked with the provider before signing.

Note: The RM2,400 annual exemption no longer applies from January 2025 onwards. The full annual rent stated in the tenancy agreement is now subject to stamp duty from the first ringgit.

      Well there is no law or rule stated in Malaysia that who should pay for the legal fee, but normally tenant will pay for it.

  • Hi on top of my head SST is not imposed on monthly rentals unlike the previous GST which were imposed on the monthly rentals of commercial properties only. Please clarify.
