Why Should I Stamp My Tenancy Agreement?

So you’ve a tenancy agreement drawn up and ready, and you’re going to hand it over to your tenant.

Stamping your tenancy agreement is really important here, considering that you can actually submit this in court as evidence (it’s legally admissible!) if you ever need to.

So here are a few reasons why you should stamp your tenancy agreement:


Stamping your tenancy agreement basically is a proof of it being real and genuine (not fake!)! The stamping should generally include the date and time of the stamping and name of the authority stamping it.


Having your tenancy agreement stamped by LHDN makes your tenancy agreement valid. The tenancy agreement is ultimately a contract that covers you and your tenant’s rights, hence the importance of stamping. The validation of your tenancy agreement adds to the security.

You don’t want your contract to be invalid or illegal. You want your rights to be protected and secured just in case you have a really bad tenant and have to bring them to court. It’s better to be safe than sorry, after all!

Step 1: Prepare 2 sets of the tenancy agreement signed by you and your tenant.

Step 2: Go to your nearest Lembaga Hasil Dalam Negeri office (LHDN office).

Step 3: Once you’re there, tell the officer you want to stamp your tenancy agreement. You’ll be given a couple of forms and a queue ticket.

Step 4: Fill in the forms and wait until your number is called.

Step 5: Submit the forms and tenancy agreements.

Step 6: Pay your stamp duty fee (you can calculate it here).
