Tenancy Renewal in Malaysia: Rent, Stamping, Negotiation Guide (2026)

Tenancy renewal is not only “same tenant, another year”. It is a fresh decision on rent, term, deposit, repairs, utilities and paperwork. If the terms change, write them down. If a new or renewed agreement is signed, check stamping.

What Usually Happens

Before expiry, either side decides whether to continue. The landlord may propose new rent. The tenant may negotiate repairs or a longer term. If both agree, they sign a renewal, addendum or new agreement. If they do not agree, the tenancy ends according to the notice clause.

Rent Increase

Malaysia does not have one automatic residential rent-increase formula for every tenancy. Market rent, property condition and the agreement matter. A rent increase should be communicated clearly and early enough for the tenant to decide.

Stamping

Negotiation Checklist

Before renewing, confirm rent, duration, deposit, utilities, repair promises, early termination, access cards, parking and whether any arrears exist. Put agreed changes in writing.
